‘Send Eddie Nketiah a voice note’ Terms and Conditions

These terms and conditions (“Terms and Conditions”) set out the basis on which you can participate in the “Send Eddie Nketiah a voice note” promotion (the “Promotion”) hosted by The Arsenal Football Club Plc (“Arsenal”). By participating in the Promotion you accept these Terms and Conditions in full. If you do not accept these Terms and Conditions, you should not participate in the Promotion.

1. PROMOTION PERIOD: The start date for participation is 18 June 2022 at the time Arsenal’s email in respect of the promotion (the “Email”) is sent to its members (“Start Date”). The closing date for participation is 20 June 2022 at 11:59 (UK time) (“Closing Date”).

2. TO PARTICIPATE: To participate in the promotion, you must send a voice message via WhatsApp (a “Message”) to the telephone number shown in the Email by no later than the Closing Date. After the Closing Date, Arsenal will select its favourite Messages (in its sole discretion) to present to its football player, Eddie Nketiah (the “Player”). You will be informed if your Message is selected for presentation to the Player.

3. ELIGIBILITY: Participation is open to Arsenal Members aged 16+ who receive Arsenal’s email in respect of the Promotion. Only one Message per person is allowed.

4. If participants are under 18, consent from a parent or guardian must be obtained prior to participation and the parent or guardian must agree to these Terms and Conditions in full. 

5. No purchase is required to participate but you will require email, internet access and access to a smartphone to participate in the promotion. No refund may be claimed for any expenses incurred relating to the use of an email account or internet connection for the purpose of participating in the promotion.

6. PUBLICITY AND PERSONAL DATA: Without prejudice to any other rights you have granted to Arsenal, by participating in this Promotion and submitting a Message, you agree that your Message may be used by Arsenal and its selected sub-licensees, in perpetuity and throughout the world in any and all media whether now known or hereafter invented without further remuneration, for Arsenal’s marketing, editorial or promotional purposes or for any other purpose deemed reasonable by Arsenal (“Permitted Purposes”).

7. Arsenal will use entrants’ personal details for the purposes of administering the Promotion. Messages received but not selected by Arsenal for the final delivery to the Player shall not be stored or retained. 8. WARRANTIES: By participating in the Promotion, you warrant and undertake that:

1. 1. you are the legal and beneficial owner of all intellectual property rights in the Message, and that your Message is your own original work and does not infringe any third party rights;  

1. 2. you have obtained all relevant rights and written permissions from individuals featured in the Message, and that your Message does not feature anyone under the age of 12 unless it is your own child and you have that child’s consent; and

1. 3. your Message does not infringe the laws of England.

9. All entrants hereby waive and agree not to assert (and warrant that all individuals featured have waived and agreed not to assert) any moral rights in and in connection with their Message.

10. All entrants agree to do such other things and execute such other documents as are reasonably requested of them by Arsenal in order to allow Arsenal to use their Message for the Permitted Purposes.

11. Arsenal reserves the right to pass on any entries which cause it concern to the relevant authorities.

12. OTHER IMPORTANT INFORMATION: Entries must not be submitted through agents or third parties. Arsenal shall have no obligation to feature your Message in any promotion or marketing it carries out, or to include the Message in any final-cut or compilation of the messages (a “Montage”) sent, provided to or shown to the Player, and Arsenal may select entries for any Montage in its sole discretion.

13. Arsenal reserves the right to withdraw or amend the Promotion or these Terms and Conditions if circumstances outside its reasonable control make this unavoidable. Entries must be strictly in accordance with these Terms and Conditions.

14. Arsenal’s decision is final in all matters relating to the Promotion and no correspondence will be entered into.

15. The Promotion is not in any way sponsored, endorsed or administered by, or associated with WhatsApp. You acknowledge that WhatsApp shall not have any liability to you in connection with the Promotion and that your participation is subject to their terms of use. Arsenal reserves the right to disqualify any participant posting a message or a comment that is, in Arsenal's opinion, inappropriate, offensive or upsetting to other participants, fans of Arsenal or directly aimed at Arsenal, or contrary to applicable law, and to remove any such entry or comment.

16. ARSENAL’S LIABILITY TO YOU: Except in respect of death or personal injury resulting from any negligence of Arsenal, to the maximum extent permitted by law, neither Arsenal nor any of its officers, employees or agents shall be responsible for (whether in tort, contract or otherwise):
    1. 1. any loss, damage or injury to you and/or any third party or to any property belonging to you or any third party in connection with the Promotion and/or the Prize (including the winner’s receipt or use of the same), resulting from any cause whatsoever; or
       2. any loss of profit, loss of use, loss of opportunity or any indirect, economic or consequential losses whatsoever and howsoever caused.

17. GOVERNING LAW AND JURISDICTION: Please note that these Terms and Conditions are governed by English law. This means that your participation in the Promotion and any dispute or claim arising out of or in connection with it will be governed by English law. You and Arsenal both agree that the courts of England will have non-exclusive jurisdiction in connection with any such dispute or claim.

18. SPIRIT OF THE PROMOTION: If you attempt to compromise the integrity or proper operation of the Promotion by cheating or committing fraud in any way, Arsenal reserves the right to render your submission and participation invalid, seek damages from you and ban you from participating in any of their future promotions.
